Terms and Conditions for the use of the JS HR Support Website and Associated Service

In these Terms and Conditions “we”, “our”, “us” and “JS HR” refers to “JS HR Support Limited”.  The Website for the purposes of these terms and conditions apply to the use of all aspects of the site including document template downloads, “ask your trusted adviser”, “How to or training guides”, the “HR Health Check”, newsletters, bulletins and any additions made at any time.  By using the site (at any time for any reason), you are bound by these terms and conditions.

1. Acceptance of Terms 

By accessing the content of http://www.jshrsupport.co.uk(“the Website”), you agree to be bound by the terms and conditions set out herein, and you accept our privacy policy available at www.jshrsupport.co.uk /privacy-policy.htm.  You are also bound by any separate agreements through which you have access to this website.  If you object to any of the terms and conditions set out in this agreement you should not use any of the products or services on the Website and leave immediately.

You agree that you shall not use the Website for illegal purposes, and will respect all applicable laws and regulations. You agree not to use the Website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Website. You also agree not to compromise the security of the Website or attempt to gain access to secured areas or sensitive information.

You agree to be fully responsible for any claim, expense, liability, losses, and costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.

By accessing the Website you are agreeing to the terms and conditions at the time of use and by using the Website you are confirming that you have read and understood these terms and conditions and will be bound by all contained.  You understand that if you do not agree to be bound by the terms and conditions you should leave the Website immediately.

By agreeing to these terms and conditions you understand that all documents are “uncontrolled” at the point of download and no responsibility for their use and any potential outcome including any subsequent loss can be attributed to JS HR or any of its Directors or its employees.  In using the Website, you also agree that any advice sought under “ask your trusted adviser” is for guidance only, as are the “Training guides “or “How to guides”. It is important that you refer yourself to our section on Limitation of Liability.

By agreeing to these terms and conditions you understand that you will be bound by all aspects regardless of whether a fee is paid or not and regardless of whether you have engaged JS HR to undertake any service under a different agreement.  By agreeing to these terms and conditions, you are confirming that you have express permission from the registered company to use the site.

2. Modification 

JS HR reserve the right to change any part of this agreement without notice and your use of the Website will be deemed as acceptance of this agreement.  We advise users to regularly check the Terms and Conditions of this agreement.

JS HR has complete discretion to modify or remove any part of this site without warning or liability arising from such action.

3. Limitation of Liability 

JS HR will, under no circumstance, be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the Website.  All documents are designed as examples only and are uncontrolled. Any guides are designed to provide basic advice and are not designed as a replacement for legal/professional advice.

Nothing within this agreement will operate to exclude any liability for death or personal injury arising as result of the negligence of JS HR, its employees or agents. This applies to all levels of membership i.e. “Premier”, “Premier Plus” or “Elite” and regardless whether the membership is free or attracts a fee paid as a monthly standing order or other means.  All information given via the Website including via, though, not limited to, “ask your trusted adviser” is intended as guidance only and is not intended as legal advice.

4. Copyright 

All intellectual property of JS HR such as trademarks, trade names, patents, registered designs and any other automatic intellectual property rights derived from the aesthetics or functionality of the Website remain the property of JS HR.  No documents may be duplicated or distributed without the express written permission of JS HR.

By using the Website, you agree to respect the intellectual property rights of JS HR and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for commercial purpose any material contained within the Website.

5. Disclaimers 

The information is provided on the understanding that the Website is not engaged in rendering advice and should not be wholly relied upon when making any related decision.

The information contained within the Website is provided on an “as is” basis with no warranties expressed or otherwise implied relating to the accuracy, fitness for purpose, compatibility or security of any components of the Website.

We do not guarantee uninterrupted availability of the www.jshrsupport.co.uk website and cannot provide any representation that using the Website will be error free.

6. Third Parties

The Website may contain hyperlinks to websites operated by other parties. We do not control such websites and we take no responsibility for, and will not incur any liability in respect of, their content.  Our inclusion of hyperlinks to such websites does not imply any endorsement of views, statements or information contained in such websites.

7. Severance 

If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.

8. Governing Law and Jurisdiction 

This Agreement will be governed by the laws of England and any user of the Website hereby agrees to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.

9. Particulars of Use 

Use is limited to access of the Website and the contents and services within.  Provision of on-line advisory services “ask your trusted adviser” is based on “office” hours and is limited to the hours of 0900 to 1700 Monday to Friday.  JS HR will endeavour to turn around queries as quickly as possible but cannot guarantee any specific time-scales for response and cannot be held responsible for any liability of advice given through the “ask your trusted adviser” function, as it is not designed to be a replacement for legal advice. All users must make themselves fully aware of their legal position when employing people including all paperwork issued directly from www.jshrsupport.co.uk.

Use is subject to the time period as confirmed by JS HR either via email and/or in a separate service level agreement.  If use is provided as part of a broader service including in-company support, cancellation and/or suspension of said broader service will result in access to the Website being withdrawn.
Membership is open to anyone within the UK but any information supplied relates the employment law of England & Wales.  Use may be refused at any time and for any reason.

E-mail support (“ask your trusted adviser”) is available during normal office hours which are Monday to Friday during the hours of 0900 to 1700.

JS HR reserves the right to restrict feedback via the website to e-mail responses at peak times (such as holiday periods).

Any additional work will not be completed until agreed in writing (email acceptable).

Any documents downloaded including the “How to “or “Training” guides are uncontrolled meaning that responsibility for checking the suitability of these before use and/or issue lies with the user of the Website.  JS HR cannot accept any responsibility for the use of any documents or guides downloaded from this site as they are designed as guides only.

Only documents that can be viewed on the Website are available under the normal use.  Any additional documents will be charged at an agreed rate. Any requests to change standard documents will be considered but any adjustments will be charged.  Documents are presented on an example only and on an “as you see them basis” so any corrections (even in the event of genuine error or omission) will incur an agreed charge.  Such errors or omissions do not alter the service and no credits can be made.

All information provided either on the Website (via the News section for example) is not designed to be a replacement for legal advice.

10. The “HR Health Check” 

The “HR HEALTH CHECK” is designed to gather basic information to provide guidance to the user. Any advice provided is guidance only and is not designed as an alternative to legal advice. JS HR accepts no liability for any guidance provided using this section and/or any actions the user may choose to take as a result of using it.

11. The E-Newsletters/HR and Employment Law Updates 

The “e-newsletter”/HR and employment updates are only provided to approved users”.  Updates are designed as guidance only.  Any advice provided is not designed as an alternative to legal advice.  JS HR accepts no liability for any guidance provided using this section and/or any actions the user may choose to take as a result of using it.

12. The Online Documents and Membership 

Access to the documents is restricted to authorised users only. “Premier” users can access an “employee pack” which will contain uncontrolled documents. The number and specific nature of these documents may change from time to time at the complete discretion of JS HR. Only the documents which are accessible at the time of logging-in will be available as part of the membership, any other documents requested may be provided but would be classed under “additional work”.

“Premier Plus and Elite” members can access all documents on the Website. 13. Contacting You 

From time to time, you may receive other emails providing information on additional services provided by JS HR or associated organisations.  Your email address will not be deliberately shared with any other company or individual. Please see our privacy notice.

14. Additional Work 

Additional work can be completed in-line with the Service Contract.  The definition of “additional work” and the cost of “additional work” will be outlined in the written Service Contract.  Additional work may also be charged out on the basis of a “fixed fee” agreement.  Fixed fees will ONLY ever be undertaken if email confirmation is received from JS HR.  In the absence of such an agreement, costs will ALWAYS be charged out at £120 per hour (+VAT): in 15-minute slots.

All additional work will be invoiced at the discretion of JS HR.  Invoices must be paid within 30 calendar days to maintain the discounted rate. For clarity purposes, failure to pay the invoice within 30 calendar days will result in the normal rate (£120 per hour +VAT: charged in 15-minute slots) being applied.  Failure to pay for additional work within the 30 days may result in an administration fee of £200 (+VAT) being applied.  Failure to pay for additional work within the 30 days may also result in suspension of membership meaning no access to the documents or any element of the service. JS HR reserves the right to charge interest for any late payments.
